TERMS AND CONDITIONS
These Terms and Conditions ("Terms") govern your use of e-bike rental services ("services") provided by Loop Trail Rentals LLC ("Loop Trail Rentals LLC", "we", "us", "our"). By renting, riding, reserving, or using an e-bike from us, you acknowledge that you have read, understood, and agree to these Terms.
1. RIDER ELIGIBILITY:
To rent an e-bike from Loop Trail Rentals LLC, you must be at least 21 years old.
All riders must be at least 16 years old and accompanied by a parent or legal guardian.
-Riders must be physically and mentally capable of safely operating an e-bike.
-Have sufficient balance, coordination, vision, hearing, and physical ability to control the e-bike.
-Follow all applicable federal, state, and local laws and regulations.
-Follow all instructions provided by Loop Trail Rentals LLC regarding the operation and use of the e-bike
-Provide accurate and complete information when making a reservation or rental.
Loop Trail Rentals LLC reserves the right to refuse or terminate a rental if it reasonably believes a rider is unable to safely operate the e-bike.
2. E-BIKE USE
E-bikes can cause serious injury or death if operated improperly.
Riders agree to:
-Operate the e-bike responsibly and within their own abilities.
-Obey all traffic laws, posted signs, trail rules, and applicable regulations.
-Maintain a safe speed appropriate for the conditions.
-Yield to pedestrians and other trail users where required.
-Remain in control of the e-bike at all times.
-Use designated bike paths and trails where required or appropriate.
-Follow all safety instructions provided by Loop Trail Rentals LLC.
-Use the e-bike only for its intended purpose.
Riders may NOT:
-Allow another person to operate the rented e-bike.
-Carry passengers
-Operate the e-bike while impaired by alcohol, drugs, medication, or any other substance that may affect judgement or coordination.
-Race, perform stunts, jumps, wheelies, or other reckless maneuvers.
-Modify, disassemble, repair, or tamper with the e-bike.
-Use the e-bike in a manner that could reasonably be expected to cause damage to the e-bike.
-Take the e-bike into prohibited areas or onto terrain for which it is not designed.
-Leave the e-bike unattended in an unsecured location.
-Transport, carry, load, or otherwise move a rented e-bike using any motor vehicle, trailer, truck, SUV, or other vehicle.
3. HELMETS:
The Rider acknowledges and agrees that an e-bike rental from Loop Trail Rentals LLC includes a helmet. Rider further agrees to wear the provided helmet at all times during the rental period.
Where helmet use is required by law, riders must comply with that requirement.
4. ASSUMPTION OF RISK:
Riding an e-bike involves inherent risks, including but not limited to:
-Falls and collisions
-Contact with vehicles, pedestrians, cyclists, animals, or other objects.
-Uneven, rocky, sandy, wet, or otherwise hazardous terrain.
-Mechanical or electrical failure.
-Loss of balance or control.
-Weather and environmental conditions.
-Serious bodily injury, disability, property damage, or death.
By renting or operating an e-bike, you voluntarily assume the risks associated with its use, including risks that may result from ordinary negligence.
5. RESPONSIBILITY FOR THE E-BIKE
The renter is responsible for the e-bike and all equipment provided during the rental period.
The renter/rider agrees to:
-Take reasonable care of the e-bike.
-Prevent unauthorized persons from using it.
-Secure the e-bike when it is unattended.
-Immediately report any accident, damage, malfunction, theft, or loss to Loop Trail Rentals LLC.
-Return the e-bike and all equipment in the condition in which they were provided, except for ordinary wear and tear.
The renter may be financially responsible for damage, loss, theft, or destruction of the e-bike or equipment resulting from misuse, negligence, unauthorized use, failure to properly secure the equipment, or violation of these Terms.
6. DAMAGE LOSS AND THEFT
The renter may be charged for reasonable costs associated with:
-Damage to the e-bike
-Damage to batteries, locks, helmets, accessories, or other equipment
-Lost equipment
-Theft of the e-bike or equipment
-Recovery or retrieval of an abandoned e-bike
-Repairs resulting from misuse or unauthorized modifications
Charges may include parts, labor, replacement costs, recovery costs, and other reasonable expenses directly related to the loss or damage.
Loop Trail Rentals LLC may use the payment method provided by the renter for authorized charges resulting from damage, loss, theft, or other amounts owed under these Terms.
7. MECHANICAL PROBLEMS OR BREAKDOWN:
If an e-bike experiences mechanical, electrical or other malfunction, the rider must stop using the e-bike when continued operation could be unsafe and contact Loop Trail Rentals LLC.
Riders must not attempt repairs unless specifically authorized by Loop Trail Rentals LLC.
Loop Trail Rentals LLC will make reasonable efforts to assist with mechanical problems during a rental. However, Loop Trail Rentals LLC does not guarantee that replacement equipment, repairs, refunds, transportation, or recovery services will always be available.
8. RESERVATIONS AND PAYMENT:
Payment is due at time of rental by card only. The renter is responsible for providing accurate payment and contact information.
Loop Trail Rentals LLC reserves the right to decline or cancel a reservation when necessary, including when equipment is unavailable, unsafe, and due to weather conditions.
9. WEATHER AND TRAIL CONDITIONS:
E-bike rentals may be affected by weather, trail conditions, road closures, excessive heat, flooding, wind, lightning, or other environmental conditions.
Loop Trail Rentals LLC may delay, modify, or cancel a rental when conditions present an unreasonable safety risk.
10. ACCIDENTS AND INJURIES:
Any accident, injury, collision, theft, or significant damage must be reported to Loop Trail Rentals LLC as soon as reasonably possible.
-In an emergency, riders should call 911
-Riders are responsible for obtaining appropriate medical care following an injury.
11. RELEASE AND LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, the renter acknowledges that participation in e-bike activities involves inherent risks and agrees that Loop Trail Rentals LLC, its owners, employees, agents, and representatives shall not be held responsible for injuries, losses, damages, or claims arising from the renters use of the e-bike.
12. INDEMNIFICATION:
To the fullest extent permitted by applicable law, the renter agrees to indemnify and hold harmless Loop Trail Rentals LLC, its owners, employees, agents, and representatives from claims, damages, losses, liabilities, costs, and expenses arising out of the renters use of the e-bike or violation of these terms.
13. PERSONAL PROPERTY:
Loop Trail Rentals LLC is not responsible for loss, theft, or damage to personal property brought by the renter or left within or on an e-bike.
14. INDENTIFICATION AND SECURITY DEPOSIT:
Loop Trail Rentals LLC may require valid identification, a credit/debit card, security deposit, or other reasonable verification before releasing an e-bike.
15. GPS AND EQUIPMENT TRACKING:
Loop Trail Rentals LLC owned e-bikes may contain GPS, Bluetooth, cellular, or other tracking technology.
Such technology may be used for purposes including locating company property, theft prevention and recovery, fleet management, maintenance, safety, and operational purposes.
16. CHANGES TO THESE TERMS:
Loop Trail Rentals LLC may update these Terms and Conditions from time to time. The current version will govern rentals made after the effective date.
17. SERVABILITY:
If any provision of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.
18. GOVERNING LAW
The Terms and Conditions shall be governed by and interpreted in accordance with the STATE OF NEVADA, without regard to conflict-of-law principles, except where applicable law requires otherwise.
19. ENTIRE AGREEMENT:
These Terms, together with any applicable rental agreement, waiver, reservation terms, and other policies referenced herein, constitute the Agreement between the Renter and Loop Trail Rentals LLC concerning the rental and use of Loop Trail Rentals LLC’s e-bikes and equipment.
By completing a rental, reservation, payment or acknowledgement, the renter confirms they have read, understood, and agreed to these Terms and Conditions.
